Genesis Financial & Payment Systems Holdings, LLC, d/b/a USA Web Cash and its subsidiaries (“USA Web Cash”) provides this website (“Site”) as a service for our customers.  The following terms and conditions of use (“TOU”) set forth the terms, conditions and rules that govern your use of this Site.

USA Web Cash reserves the right, but is not obligated, to limit the sales of its products or services to any person, geographic region or jurisdiction.  We may exercise this right on a case-by-case basis.  All descriptions of products and services and pricing are subject to change at any time without notice at the sole discretion of USA Web Cash.  USA Web Cash reserves the right to discontinue any loan product or service at any time.  Any offer for any product or service made on this Site is void where prohibited.

The TOU will remain in effect until you notify us that you no longer wish to use the Site, or you cease using the Site.  Notwithstanding anything in this TOU to the contrary, the parties understand and agree that all terms and conditions of the TOU that may require continued performance, compliance, or effect beyond the termination date of this TOU will survive termination of the TOU and will be enforceable by the parties USA Web Cash may also terminate the TOU at any time and may do so immediately without notice and, accordingly, deny you access to this Site, if, in USA Web Cash’s sole discretion, you fail to comply with any term or provision of the TOU. 

These TOU will be governed and construed in accordance with the laws of the State of Illinois, without regard to its conflicts of law rules.  For all disputes arising out of or relating to this Site or TOU, you submit to exclusive personal jurisdiction and venue of the state and federal courts located in Cook County, Illinois and agree and consent that such courts are the exclusive forum for litigation of any claim or cause of action arising out of or relating to your use of this Site or the Content. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or relating to your use of this Site or the Content must be filed within one year after such claim or cause of action arose or be forever barred.

You understand and agree that if USA Web Cash sends you a Communication but you do not receive it because your primary email address on file is incorrect, out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, USA Web Cash will be deemed to have provided the Communication to you, however USA Web Cash may deem your account inactive. You may not be able to transact using our Site until USA Web Cash receives a valid, working primary email address from you. If you use a spam filter or similar software that blocks or re-routes emails from senders not listed in your email address book, USA Web Cash recommends that you add USA Web Cash to your email address book so that you can receive Communications by e-mail. USA Web Cash is not liable for any loss or damage arising from (i) your failure to access, download, save or print Communications; (ii) problems or technical failures with your equipment, and (iii) any errors or delays in electronic communication or transmission lines that are beyond USA Web Cash's reasonable control.

USA Web Cash is committed to protecting the privacy of the visitors to this Site.  For information on how information is collected, used, or disclosed by USA Web Cash in connection with your use of this Site, please consult our privacy policy.  Your use of the Site constitutes acknowledgement and agreement with our privacy policy.  You further acknowledge and agree that USA Web Cash may use your personal information in the manner described in our privacy policy.

By providing USA Web Cash with your email address you consent that we may send email messages to your email address as further described in our privacy policy. Email services are provided on an "AS IS" basis.

YOUR SOLE REMEDY AGAINST USA Web Cash FOR DISSATISFACTION WITH THE SITE OR ANY CONTENT IS TO STOP USING THE SITE OR ANY SUCH CONTENT. THIS LIMITATION OF RELIEF IS A PART OF THE BARGAIN BETWEEN THE PARTIES.

The provisions and conditions of the TOU constitute the entire agreement between USA Web Cash and you related to the use of the Site and supersedes any prior agreements or understandings not incorporated in the TOU in connection with the use of this Site.  The TOU are effective as of the Effective Date.  Continued use of the Site by you after the Effective Date constitutes your acceptance of the TOU as of the Effective Date.

USA Web Cash does not waive any rights set forth in these TOU or our right to enforce these TOU by merely choosing not to exercise or enforce our rights in a particular circumstance.  If any application of a provision of these TOU is held to be invalid or unenforceable to any extent, the remainder of these terms, or the application of such provision in other circumstances, will not be affected by such holding and every other provision may be enforced to the fullest extent permitted by law.  These TOU constitute the entire agreement between you and us with regard to your use of the Site, and will not affect, supersede, or modify any terms or conditions set forth in specific loan agreements.
